Then explained that she'd received several violation notices and wanted clarification concerning the association's authority over her parcel.

The president smiled tightly.

“You received our governing documents.”

“Yes.”

“Then you know the rules.”

The homeowner nodded.

“I've reviewed the documents supplied.”

She opened her folder.

“But the recorded plat and the original declaration appear to exclude my parcel from the general subdivision restrictions.”

The room became still.

One board member looked up.

The HOA president's expression changed.

“What did you say?”

The homeowner remained calm.

“The house predates the association.”

She placed a copy of the recorded map on the table.

“I'd appreciate the recorded instrument that subjects my property to the association's full declaration.”

The president stared at the map.

Then pushed it away.

“Every house in Willow Ridge follows our rules.”

The homeowner nodded.

“That's a general statement. I'm asking for the recorded document.”

The older woman leaned forward.

“You don't come into our community and tell us how things work.”

The homeowner remained calm.

“I'm asking a property-record question.”

The president's voice sharpened.

“And I'm telling you this board has authority.”

The homeowner looked toward the other members.

“Then there should be documentation establishing it.”

Several residents began whispering.

The association treasurer, a quiet woman in her sixties, leaned toward the map.

“May I see that?”

The president quickly placed one hand over it.

“We're not turning this meeting into a legal seminar.”

The homeowner looked toward her.

“I'm not asking for a seminar.”

Her voice remained polite.

“I'm asking for the legal basis for the notices.”

The president's face reddened.

“You have three minutes. Your time is finished.”

The homeowner nodded.

“Thank you.”

She collected her papers.

Then sat down.

The older woman glared at her throughout the rest of the meeting.

When the meeting ended, the treasurer approached quietly.

She looked nervous.

“May I ask you something?”

The homeowner smiled.

“Of course.”

The treasurer glanced toward the president, who was speaking angrily with another board member across the room.

Then she lowered her voice.

“Where did you get that older subdivision map?”

“The county land records.”

The treasurer nodded slowly.

“I thought so.”

The homeowner studied her.

“Why?”

The older woman hesitated.

Then whispered, “Because I asked about that property last year.”

The homeowner became still.

“And?”

The treasurer glanced toward the president again.

Then answered.

“I was told not to bring it up.”

For several seconds, neither spoke.

Then the treasurer looked directly into the younger woman's eyes.
