A young attorney said:

“Why?”

“Because institutions are difficult to understand if you force everyone into good people and bad people.”

The attorney frowned.

“He arrested you for attitude.”

“Yes.”

“He can still have delivered groceries.”

“So?”

“So we investigate the conduct.”

“Not whether every story about him is ugly.”

The attorney nodded.

Not fully convinced.

She would be later.

The sheriff gave his first formal state interview four days after the arrest.

Attorney present.

He looked exhausted.

No aviator glasses.

No public swagger.

The interviewer asked about the initial traffic stop.

The sheriff defended it.

He had seen the car touch the center line.

The Black counsel had been distracted.

The vehicle was unfamiliar.

He asked questions.

She became evasive.

The investigator said:

“Body camera shows her answering every identification question.”

The sheriff replied:

“She refused the briefcase.”

“Was the briefcase related to the alleged lane violation?”

“I developed suspicion.”

“Of what?”

“Possible stolen property.”

“What indicated that?”

“Expensive vehicle.”

“Out-of-county driver.”

“Locked case.”

The investigator looked toward him.

“Are locked briefcases unusual for attorneys?”

The sheriff’s attorney shifted.

The sheriff said:

“Context.”

“What context?”

“She had attitude.”

Silence.

The sheriff seemed to hear the word differently in the quiet interview room.

The investigator asked:

“Define attitude.”

The sheriff looked annoyed.

“Combative.”

“Did she threaten you?”

“No.”

“Raise her voice?”

“No.”

“Physically resist?”

“No.”

“Refuse identification?”

“No.”

“Attempt to leave?”

“She asked if she was free to go.”

“Did she leave?”

“No.”

“What was combative?”

The sheriff leaned back.

“She challenged everything.”

The investigator nodded.

“So verbal challenge.”

“Yes.”

“Is verbal challenge a criminal offense?”

“No.”

The sheriff’s attorney looked down.

The investigator continued.

“Why arrest?”

The sheriff stared.

Then said something more honest than anyone expected.

“Because I was angry.”

The room became quiet.

The investigator asked:

“Why?”

The sheriff looked toward the mirror on the wall.

He knew someone might be behind it.

“I felt like she was testing me.”

“Was she?”

“I don’t know.”

“What did being tested mean to you?”

The sheriff rubbed his mustache.

“That if I backed down, she’d think she could run the stop.”

The investigator asked:

“Was there a safety concern?”

“No.”
